Online piracy bill has free speech supporters up in arms
Artists who use others’ work could be fined or have their websites shut down

A bill being considered by a House of Representatives committee last month could divide the art world into two camps: those who want to protect their creations from being used online and those who like to use the work of others. The legislation, intended to stop piracy on the web, is meeting strong opposition: Wikipedia co-founder, Jimmy Wales, has proposed a blackout on their site. The measure would impose criminal fines and allow the US government and individuals to shut down websites for alleged infringement. Critics say the steps would restrain free speech and cause service providers to filter out content they were unsure of.
Theodore Feder, the president of the Artists Rights Society in New York, says that it backs the bill, saying: “It will help to curtail online piracy, which adversely affects the interests of our artist members.” He says that the law would help “remedy some of the weaknesses” of copyright protection in the digital age.

Music and film producers want the bill to be passed. Online giants like Google, Twitter and Yahoo are opposed and “techies” devoted to a free internet are up in arms.

The bill, the Stop Online Piracy Act (Sopa), introduced by Republican representative Lamar Smith, is designed to fight websites identified as dedicated to copyright infringement. If passed, the attorney general could require US internet providers to deny access to such sites and could require advertisers and payment services, such as Paypal, to stop doing business with them. If the service provider acts reasonably to comply with the order, or voluntarily stops business with a suspected site, it would be immune from liability. The bill also makes it a crime to distribute or reproduce electronically a copyrighted work with a value over $1,000.

Laurence Tribe, a professor of law at Harvard, says that Sopa has “grave implications for publishers and creative artists. It will diminish the availability of art images on the web” and “dramatically chill protected speech”.

“Artists who want to make fair use of another artist’s work, as part of a work posted online, could be threatened,” says Art Brodsky, the communications director for Public Knowledge, a Washington, DC-based organisation that supports digital rights. “Whether it’s an image or a film clip, the hosting site could have its financial support cut off, or even be subject to closure.”

The bill could affect artists who don’t infringe copyright because if an artist’s work is on a site “that also hosts or links to allegedly infringing work, that whole site may become essentially invisible”, says Julie Samuels, a lawyer at the San Francisco-based Electronic Frontier Foundation, a civil liberties group. She says that sites that host user-generated content, like the video site YouTube or the arts and craft marketplace Etsy, “won’t be able to survive”.

Robert Panzer, the executive director of the Visual Artists Gallery Association in New York, which advises artists on copyright, says that while his organisation supports “any legislation that gives new tools to rights holders”, Sopa primarily addresses corporate needs. He says Congress should create a small claims copyright court, to let creators pursue the “thousands of infringements on the web” that are now “too costly to pursue”.

In November, Google, Twitter, Mozilla and other internet companies wrote to Congress asking it to consider “more targeted ways” to combat rogue websites. A letter signed by a founder of the image sharing site Flickr says that Sopa would suppress innovation. The law would empower the US government “to censor the web using techniques similar to those used by China”, the letter says.

1. Piracy is unauthorized copying and usually distributing of music, art, books, tv shows, movies, or trademarked products.

2. I think Google, Youtube, Mozilla and Yahoo are opposed to the SOPA Act because it will affect them negatively. Many people look up book works, artwork, tv shows or movies on the internet, and if the SOPA Act goes into effect, they will lose a lot of business and users because of the act.

3. Based on what I've read, copyright laws apply to all artists in any kind of industry involving music, art, writing or publishing, movies or tv shows. In order to have protection on their work, they need copyright laws so no one can copy their work and use it to make their own profit.

4. They believe that Congress should create a small claims copyright court, to let creators pursue the “thousands of infringements on the web” that are now “too costly to pursue”.

5. SOPA is the Stop Online Piracy Act. I believe if they pass this law there is a greater increase of print that will come about from this act but I don't think it will drastically increase back to print because our generation is too advanced in society to go backwards, only forward. I think the web has effected our economy positively because it has advertised many things and created a much higher profit for many businesses. I personally believe that artists and musicians deserve more recognition and profit because they work hard to become successful and people are stealing from them. But I don't necessarily believe the web in general has had a positive affect on our society and economy.

1. Piracy is illegally reproducing copyrighted materials.

2. I think that these sites would be opposed to the SOPA laws because they unintentionally host these pirated materials in abundance. By taking them away, a large portion of their sites would be unusable and cause them to lose the support of many users. Overall, these sites would be crippled by the law and could potentionally be caused to shut their sites down entirely. They don't feel that the materials would be judged appropriately either.

3. Artists' Copyright goes into affect once the art is created. This means that once it is finished, one needs permission and/or payment of its creator to be reproduced.

4. Robert Panzer and the executive director of the Visual Artists Gallery Association in New York suggest that a "small claims copyright court" be created in order to dispute the many copyright infringements of the internet. They feel that this would benefit the bill and the sites under investigation.

5.a. SOPA stands for Stop Online Piracy Act. This bill hopes to stop all online distribution of copyright infringed materials. It would shut down sites "dedicated to copyright infringement".
b. If the web isn't available to advertise or promote any longer, I think it would only make sense to go back to print. I don't see how it would be practical after having so much reliance on the internet for it, however there would be no other way to publicize.
c. I think that the web has both helped and hurt our economy. The music industry is a prime example of benefiting and hurting from the internet. On one hand, musicians have gotten more than double the amount of exposure due to the internet than in prior years. However, the pirating of music has hurt CD sales tremendously. I think that the benefit outways the damage, however. Musicians get more exposure leading to more ticket and merch sales. The money they make from these two areas alone outways the money they would recieve from record sales.

1.Piracy is the taking and using of copyrighted or patented material without authorization or without the legal right to do so.

2.Websites such as Google, Mozilla, yahoo, YouTube, etc, are opposed to the SOPA laws because they essentially become homes to pirated materials little to their own knowledge. The removal of this material would essential remove a large bulk of the information on the websites leading to the diminishing in the number of users and supporters. These sites would essentially be hurt by these laws as it would most likely cause their shutting down.

3.Artists’ Copyright laws are given to all artists. They are put into action once a piece of art is created. This means that once someone finishes a piece of work and it is released to the online or even real print world permission or payments to the creator are necessary in order to use.

4.The Visual Artist’s Gallery Association in NY believes that Congress should create a small claims copyright court which would let the creators pursue all of the infringements on the web that at this time are too costly to pursue.

5.SOPA is the Stop Online Piracy Act that is a US bill to expand the ability of US law enforcement to fight online trafficking in copyrighted intellectual property. Although seemingly impractical, if there are no other means of advertising or promoting products, print seems like the only solution. Right now the web is the primary means of advertising and without it print seems like the only alternative to promote goods. Despite piracy complications, the web has certainly affected the US economy for the better. The web has allowed for the easy purchasing of goods, shipping and transportation of goods. The web has essentially become a tool that makes processes that in print would take a long period of time a very short period and very easy. In regards to music, the web has both helped and hurt. Musicians have been able to get more recognition and exposure from the internet; however, the piracy of music has become a very apparent and harmful problem caused by the availability of music on the internet.

1. Piracy means robbery and the unauthorized reproduction of ones work.

2. Those huge internet companies like Yahoo, Facebook, Google, and Twitter would be against it because they want a free internet. If SOPA were to be passed, free speech will be crushed and web sites will be blocked left and right. Google suggested an alternative: OPEN. OPEN stands for Online Protection and Enforcement of Digital Trade. OPEN is an act made by a Representative of California and it puts the International Trade Commission in charge of enforcing piracy.

3. The copyright law for artists is that they have their own rights to their images, paintings, videos, etc. No one is supposed to reproduce another persons work because its technically illegal. With SOPA, these laws would be enforced greatly and artists and musicians would be extremely happy.

4. The Visual Artist's Gallery Association in NY believe “any legislation that gives new tools to rights holders” should be created because the artists want their rights protected and do not want other people claiming to have took the same photo or painted the same picture.

2. I think that large, well known sites such as google and youtube are being affected by this because anyone can publish things on those websites. Because these things are not being approved of first, anyone can put someone else’s work up on the web.

2.Much of the Web opposes these bills because they restrict peoples freedoms on the internet. If the entertainment industry has its way, traffic on the internet will wane. Advertisements will cease, and much of the modern economy will be destroyed.

3.Once a work is created by an artist, the copyright laws are in effect. People must immediately pay for it.

4.The Visual Artist's Gallery Association wants Congress to create a small claims copyright court. This court will act seperatly from other parts of government to allow quick action against all infringments upon copyright laws.

5.The Stop Online Piracy Act will stop the release of copyrighted materials on thee web in an unauthorized fashion. This means, Sharing and File Hosting sites will be shut down. 3. With what I read, the copyright laws protect artist's works from being misused. They allow someone to copyright a piece of their work. When someone copyrights it, then it is the owner's right to allow the work to be published and brodcasted.

3. Copyright gives you exclusive rights to an item, including the right to reproduce and sell it, and to make derivative works from it (eg paintings adapted from the original) as well as the right to display the copyrighted work in public.

I think the web has had a good effect on the economy in terms of all of the online shopping and advertising done on it. However, in the cases of these artists it has hurt them with all the access to illegal downloading of art.

2. All of those websites and organization are opposed of SOPA because it will harm their site, and potentially shut them down. Some of these sites don't know they are hosting illegal which SOPA will find right away and take the site down.

3. When a musician, movie producer, or any type of artist creates something the copyright law goes into effect immediately. They get money by people purchasing their songs and movies but when someone hosts the movie over the internet for free, the bands and other artist aren't gaining any money from it, which they deserve. Technically they are stealing from the artist. The copyright law protects the artists work from being copied and used for profit.

4. The Visual Gallery Association in New York believe congress should make a copyright court so they can resolve the dispute and help the targeted sites and the bill itslef.

2-Those websites may have user uploaded content that would cause the website to be punished. They suggested an act to more specifically target the “rogue websites”

3-“First off, the moment you create ANYTHING visual—paintings, drawings, photographs, sculptures, etc—the only person who is allowed to copy that art is you. If you decide to sell prints of one of your paintings, you can. If anyone else does, without your written permission, you have the right to take them to court and sue for damages.
In fact, copyright laws are so strong that your family or legal heirs will still own the copyright to your artwork until 70 years after your death.”(emptyeasel.com)

2. I think websites such as google, mozilla, and yahoo are apposed to SOPA for the main reasons that they will lose business and users, and because a lot of people would stop supporting them if they had joined with SOPA. Youtube however is against it because a lot of free user generated content is on there, and it would dwindle as a website/community.

3. While piracy does hurt the industry of art and music, it also gives them just as much, if not more business because people can see their songs and it draws positive press.

4. They believe that there could be a new smaller court for smaller claims to let creators go after people who pirate their art without costing too much money that makes it unworth it.

If SOPA passes however it wont stop many people, as our generation will always find ways around blocks and other obstacles. This will affect them because many people might not want to use these websites becuase they might be scared that they will be accused of piracy.

3. Essentially, copyright laws provide artists (whether it is music, photography, video, etc.) with the authorization to have their works to be protected. In this way, it makes it illegal to use the work without permission unless the artist is making a profit.

4. They essentially believe that a small claims copyright court should be established so that artists themselves can pursue the ‘pirates’ using their copyrighted work illegally. As a broader government tracking program would be far too costly to establish, so artists can take it upon themselves to ensure justice.
